BOGOF - pricing legal services

After a brief outing into the newsworthy world of injunctions, I'm going back to more workaday matters. Keeping control of departmental budgets and getting value for money from external lawyers. This isn't a popular topic. I've seen plenty of negative comment about the recent article in the Economist on legal services ("A less gilded future"http://econ.st/lMdImV). I have reservations about the article too, but not because of the line which offended many…See More

Law, Business, Sex & Cookery

Right. This one is going to be a little different, more of a polemic. Before we get to talking about sex and cookery, let's discuss elitism and intellectual snobbery. Many of those reading this post are lawyers, and, judging by a continuing theme on twitter and in blogs, there are a good number of lawyers who believe that the law is an Olympian construct of the intellect, a triumph of ideas, far above the grubby world of business. This notwithstanding that many of history's eminent lawyers,…See More

How hard can it be? HR in law firms

This week CMS Cameron McKenna (CMCK) announced they were outsourcing the whole of their HR function to Integreon. Yawn, yawn. Who cares? It's not a real profession is it? I mean, seriously, how hard can it be? Aren't they just removing a back office administrative function and reducing costs for their clients? Before we try to answer that question, I ought to declare an…See More

Name the behaviour - what makes a lawyer successful in-house?

For a very few people, usually labelled as eccentric or rude, telling someone to their face what you really think of them comes naturally. But for most of us, it's something we have to learn. Unless we're taught how, most of us struggle to pass judgement (out-loud) on a person sitting opposite us. It feels faintly sociopathic, like Hannibal Lecter talking to Clarice Starling in The Silence of the Lambs. People go to great lengths to avoid it. But, in business life, telling people how they're…See More

"Excellent post Tom - I really enjoyed reading it.  The Reebok Rules were also great reading; all of this is clearly enormously and directly applicable in whatever field we find ourselves working in.  It's made me really think what I…"

If you aren't in on Saturday, don't bother showing up on Sunday

When he was CEO of Goldman Sachs, Hank Paulson reportedly had a notice sitting on his desk that read "If you aren't in on Saturday, don't bother showing up on Sunday". Very droll. The message was intended, no doubt, to make the point that it would take 24/7 commitment to keep up with his legendary work rate. If you'd been one of his team, maybe you'd have signed the Faustian pact. By that point, Paulson had amassed a personal fortune estimated at $600M. If you'd already made it onto his staff,…See More

Tom Kilroy commented on Tessa Armstrong's blog post Should we be placing more importance on helping to build the personal development skills of newly qualified solicitors?
"Tessa. This is a really useful post. The answer to the question you pose is "yes" of course we should invest more in training. I've been in house now for too long to qualify me to comment on law firms, but I can tell you that when I…"

Scott Stemp commented on Tom Kilroy's blog post Principles Based Regulation - let's not do that again
"Great poast!  But the trouble is, no-one would want to implement a system that is actually workable in theory and in practice (at least, no-one appears to have shown much interest in doing so at the moment).  Much better to keep swinging…"

Principles Based Regulation - let's not do that again

Imagine yourself back in the Spring of 2007. Everyone was feeling pleased with themselves. The problems with our system of capitalism had been solved. We'd outsmarted all the generations that preceded us, even the brainy ones who thought they understood the dismal science of Economics. The cycle of boom and bust had been abolished, through the wonders of excellent economic management. Ed Balls had been appointed City Minister the previous year. In his first speech, he promised that "nothing…See More

"Hi Tom Nice piece. Also looking forward to the piece on value/billing. I couldn't agree more in respect of the emails.  Have you read the 4 Hour Work Week by Tim Ferriss ? That book contains a lot that we lawyers could learn from."

It's your job to ignore thousands of e-mails

When the UK's satirical magazine Private Eye wants to refer my profession, they often use the phrase "a proven lawyer". And nothing proves a lawyer more convincingly than the desire to ensure all the loose ends are nicely tied up. It's almost a professional requirement to be a little OCD. Asking yourself "did I remember to lock the front door?" ten times on the bus to work is not really all that different from asking "did I cross reference sections 17.2(a), 9.1(b) and 4.3 with the Statement of…See More

I like the post - it's not just in-housers who haven't sharpened up their elevator pitch.
